Applicability of the Terms of Use
Any use of the gonativeguide.com website, as a website visitor, a guest, constitutes an agreement to all terms and conditions and warrants that users understand, agree to and accept all terms and conditions contained here. Guests using our website are required to respect our Code of Conduct for guests described below.
Terms and Definitions
Website:
the gonativeguide.com website (the Website) is an online platform helping tourists to find friendly local tour guides and book guided tours all over the world. We are a marketplace where demand (tourists) meets supply (local guides).
Guests:
Guests are the customers of goNativeGuide, using the website to find and book a guided tour and communicate with local guides. This text also refers to guests as: “you” or “the tourist”.
Guides:
Guides are local, licensed tour guides who are the suppliers of the guided tours listed on the Website. goNativeGuide guides are defined as such when their profile appears online on the Website and they can receive bookings via the Website.
Bookings
Guests can book a guided tour using the Website. Bookings are subject to confirmation based on the availability of our guides. goNativeGuide guarantees that the booking will be either confirmed within 48 hours or the guest will be notified that no guide is available at the given time.
By booking a guided tour through our website, guests enter into a direct contractual relationship with the guide leading the tour. From the point when the booking is made, goNativeGuide acts solely as an intermediary between the guest and the guide. goNativeGuide is not a party to any agreement between the guest and the guide and is not liable for any (attributable) failure to perform or other direct, indirect or consequential damages arising out of this relationship.
A booking is only valid when confirmed by goNativeGuide via e-mail and the guest paid the in-advance payment.
Guests making a booking with goNativeGuide understand our cancellation policy described below.
Payments
Guests pay us an in-advance payment beforehand. You have to pay the remaining amount to the guide directly after the tour.
Cancellations
If you cancel your confirmed booking, goNativeGuide will refund you the in-advance payment only in the following exceptional situations:
- An official travel warning or restriction was announced for your destination after your booking
In any other situations, goNativeGuide will not refund you the in-advance payment. In this case, you do not need to pay the rest of the amount to the guide either.
If the booking is cancelled by the guide, goNativeGuide will refund you the full amount of the in-advance payment. goNativeGuide is not liable for any direct, indirect or consequential damages arising out of the cancellation.
Code of Conduct for Guests
Any usage of the goNativeGuide website must be in line with our Code of Conduct by which users agree:
- To respect the professionalism of their local guide
- To not behave in an offensive, aggressive, threatening, harassing, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred towards their local guide and surrounding people
- To not to try to bypass the online booking system of the Website and arrange a tour without booking it on the Website
- To not contact a goNativeGuide guide for a purpose other than:
- Arranging details of the booking for a goNativeGuide tour
- Arranging details of the tour
- Asking for local tips & advice
- To respect local customs and rules & regulations
Issues and Complaints
We'll assist you in case of issues or complaints where possible. To report an issue or complaint, please send an email to support@gonativeguide.com.
Complains or issues with a guided tour: goNativeGuide is not responsible in any way for the services provided by the guides to the guests. At the same time, we'll do our best to mediate in finding a reasonable solution between guest and guide.
For any issues or complaints, you agree to contact goNativeguide within 3 days after the complaint has arisen and you agree to cooperate with and assist goNativeGuide in good faith.
Any complaint that is submitted after the 3 days period, may be rejected.

Quality of Information
The information we disclose on the Website is based on the information provided to us by the guides. Although we will use reasonable skill and care to verify the information of the guides and the quality of the tours, we cannot guarantee that all information is accurate, complete and/or correct. Each guide remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information they provided and displayed on our Website. Therefore, use your own best judgment when using any of the services provided by our guides.
Notwithstanding the foregoing, all information on the Website, including without limitation any content, data and any information related hereto, is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, express or implied, including but not limited to warranties of title or non-infringement or implied warranties of use, merchantability or fitness for a particular purpose or use.
Disclaimer
We do our very best to make sure all the information we provide you is 100% correct. However, as we are human beings too, errors can be made.
We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to the availability, reliability, or quality of our website and services, the tours distributed through us, including the nature and quality of the tours, and goNativeGuide is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our users, especially our guides. We do not endorse any entity, product or service mentioned in any user generated content available on our website.
Liability
goNativeGuide’s responsibility is limited to facilitating the availability of our Website. The participation in any of the tours lead by the guides is at your own risk.
goNativeGuide’s liability for damages shall be limited to the amount paid to us by guests.
Except as provided herein, in no event shall goNativeGuide be liable for any indirect, special, incidental or consequential damages of any kind, whether in an action of negligence or other tortious actions resulting from or arising out of participation in any of the tours lead by the guides.
Warranties
goNativeGuide does not warrant that this website and/or our services will be uninterrupted or error-free. It may correct, modify, amend, enhance, improve and make any other changes to the website and services at any time or discontinue displaying or providing any content or features without a notice to any user.
Proprietary Material
goNativeGuide content may not be used or copied without explicit authorization from goNativeGuide.
All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively "Proprietary Material") on this website is owned by goNativeGuide, or is used with the owner’s permission. This Proprietary Material is protected in all forms, media and technologies. Users may not copy, download, use, redesign, reconfigure, or retransmit anything from this website without goNativeGuide' prior written permission.
Governing Law
To the extent permitted by law, these Terms and Conditions and the provision of our services shall be governed by and construed in accordance with Estonian law and any and all dispute arising out of these Terms and Conditions and our services shall exclusively be submitted to the competent Court in Tallinn, Estonia.
